FY 2005 EMERGENCY SUPPLEMENTAL
APPROPRIATIONS ACT
CHEMICAL WEAPONS DEMILITARIZATION
SEC. 1115. (a) (1) Notwithstanding
section 917 of Public Law 97-86, as amended, the funds appropriated or other-wise
made available by the Department of Defense Appro-priations Act, 2005 (Public
Law 108-287), the Military Construction Appropriations and Emergency Hurricane
Supplemental Appropriations Act, 2005 (Public Law 108-324 and other Acts
for the purpose of the destruction of the United States stockpile of lethal
chemical agents and munitions at Blue Grass Army Depot, Kentucky, and Pueblo
Chemical Depot, Colorado, that had not been obligated as of March 15, 2005,
shall remain available for obligation solely for such purpose and shall be
made available notlater than 30 days after the date of the enactment of this
Act to the Program Manager for Assembled Chemical Weapons Alternatives for
activities related to such purpose at Blue Grass Army Depot, Kentucky, and
Pueblo Chemical Depot, Colorado.
(2) The amount of funds appropriated
or otherwise made available by the Department of Defense Appropriations Act,
2005, the Military Construction Appropriations and Emergency Hurricane Supplemental
Appropriations Act, 2005, and other Acts for the purpose of the destruction
of the United States stockpile of lethal chemical agents and munitions at
Blue Grass Army Depot, Kentucky, and Pueblo Chemical Depot, Colorado, that
had not been obligated or expended as of March 15, 2005, is $372,280,000.
(3) Of the funds made available to
the Program Manager under paragraph (1), not less than $100,000,000 shall
be obligated by the Program Manager not later than 120 days after the date
of the enactment of this Act.
(b)(1) Notwithstanding section 917
of Public Law 97-86, as amended, none of the funds appropriated or otherwise
made available by the Department of Defense Appropriations Act, 2005, the
Military Construction Appropriations and Emergency Hurricane Supplemental
Appropriations Act, 2005, and other Acts for the purpose of the destruction
of the United States stockpile of lethal chemical agents and munitions at
Blue Grass Army Depot, Kentucky and Pueblo Chemical Depot, Colorado, may
be deobligated, transferred or reprogrammed out of the ,4ssembled Chemical
Weapons Alternatives Program.
(2) The amount appropriated or otherwise
made available by the Department of Defense Appropriations Act, 2005, the
Military Construction Appropriations and Emergency Hurricane Supplemental
Appropriations Act, 2005, and other Acts for the purpose of the destruction
of the United States stockpile of lethal chemical agents and munitions at
Blue Grass Army Depot, Kentucky, and Pueblo Chemical Depot, Colorado, is
$813,440, 000.
(c) No funds appropriated or otherwise
made available to the Secretary of Defense under this Act or any other Act
may be obligated or expended to finance directly or indirectly any study
related to the transportation of chemical weapons across State lines.
