Another attempt in the form of a motion for summary judgment will be made today to stop deactivated VX nerve gas waste shipments to Port Arthur.
A news release from the Chemical Weapons Working Group, one segment of several in the opposition camp, said the motion claims the U.S. Army withheld "critical evidence" in a July preliminary injunction hearing in a U.S. District Court in the Southern District of Indiana.
That information concerned identification of viable on-site alternatives to the transportation option, the group claims. The motion also makes five other claims, some of which have been presented to the court before, the release said.
The neutralized wastewater is being incinerated at the Veolia facility in Port Arthur. Earlier this month, Veolia officials said they had destroyed about half of the 430 shipments specified in the contract with the U.S. Army.
The remaining disposal work would take about another year.
